Blujay Painting Terms and Conditions

These Terms and Conditions («Terms») govern your use of the blujaypainting.com website (the «Site») and the services offered by Blujay Painting («Company,» «we,» «us,» or «our»). By accessing or using the Site or engaging our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of the Site and do not engage our services.
2. Painting Services and Quotes
Requesting a Quote: The «Get a Free Quote» form on the Site is for preliminary contact only. Submitting a request does not create a contract for service.
Estimates: Any cost estimates provided verbally, through the Site, or via email are initial estimates only.
Final Contract: The final scope of work, price, payment schedule, and timeline will be documented in a separate, written, and signed Service Agreement or Contract between Blujay Painting and the client. This signed contract will supersede any prior estimates or quotes.
Cancellations: If a formal contract is signed, cancellation policies will be governed by the terms outlined in that Service Agreement.
3. User Obligations
As a user of the Site and our services, you agree to:
Provide accurate, current, and complete information when requesting a quote or communicating with us.
Use the Site only for lawful purposes.
Not interfere with the security or operation of the Site.
4. Payment Terms
Payment terms, including deposit requirements, payment schedules, and acceptable payment methods, will be clearly defined in the signed Service Agreement for your project.
Failure to make timely payments may result in a delay or cessation of work, as specified in the service contract.
5. Intellectual Property
The Site and its original content, features, and functionality, including logos, text, graphics, and images, are and will remain the exclusive property of Blujay Painting and are protected by copyright, trademark, and other laws.
You may not use any trademarks or copyrighted materials appearing on the Site without our prior written consent.
6. Disclaimer of Warranties
The Site and services are provided on an «as is» and «as available» basis. Blujay Painting expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
In no event shall Blujay Painting, nor its owners, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of, or inability to access or use, the Site.
Any unauthorized access, use, or alteration of your transmissions or content.
Any third-party conduct or content on the Site.
8. Indemnification
You agree to defend, indemnify, and hold harmless Blujay Painting and its owners, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any intellectual property or privacy right.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Missouri, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the date of the last revision at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
